If you are building AI features for EU customers, your compliance plan is probably split between two emotions: “we need to be ready” and “the rules are still moving.”
In late March 2026, EU lawmakers made that second feeling more rational.
The European Parliament’s amendments to the EU AI Act’s rollout aim to push key “high-risk” compliance dates into 2027/2028, extend the runway for watermarking obligations until late 2026, and introduce a targeted prohibition on non-consensual “nudifier” systems.
This is not “the AI Act is gone.” It is “the EU is buying time and tightening one specific harmful use case.”
What happened (with dates)
The Parliament’s amendments propose fixed application dates for parts of the AI Act:
- 2 December 2027 for “high-risk” AI systems specifically listed in the regulation (biometrics, critical infrastructure, education, employment, essential services, law enforcement, justice, border management).
- 2 August 2028 for AI systems covered by EU sectoral safety and market-surveillance legislation.
- 2 November 2026 as the proposed deadline for providers to comply with watermarking rules for AI-generated audio, images, video, or text.
In the same package, MEPs propose a new ban on “nudifier” systems that create or manipulate sexually explicit or intimate images resembling an identifiable real person without consent (with an exception where “effective safety measures” prevent creation of such images).
Separately, the Council said on March 13, 2026 that it agreed its negotiating position on a law intended to streamline parts of the AI rulebook — a sign this is moving into the phase where EU institutions try to converge on a final text.
Why the delay matters more than it sounds
Most builder discussions about the AI Act have focused on what is regulated (risk tiers, documentation, transparency). The practical pain has been when the detailed obligations become unavoidable — especially for teams shipping products that touch regulated workflows (HR, education, lending, healthcare-adjacent triage, identity, fraud, border/security contexts).
Two things happen when lawmakers push dates out:
- Procurement slows down less. Buyers who already want AI features can justify moving forward if they believe enforcement is farther out — but they will still demand contract terms that look like compliance (audit hooks, documentation, data handling, incident reporting).
- Standards and vendor tooling have time to catch up. The EU’s compliance reality is shaped by harmonised standards, notified bodies, and the “paperwork layer.” Delays can be an admission that the ecosystem is not ready yet.
Who is affected (and how)
Builders shipping “high-risk-adjacent” features
If your product lives near high-stakes decisions (hiring, student assessment, credit, identity verification, access control), the takeaway is not “ignore the AI Act.” It is:
- expect enterprise checklists to harden before the legal deadlines do
- design for traceability by default (data lineage, model/version tracking, human override points)
- treat documentation as a feature, not a PDF you generate at the end
Generative AI teams (watermarking)
The proposed watermarking runway is the most builder-operational part of this change.
If you operate a generative model or a consumer-facing generation feature, you should assume watermarking and provenance will become table stakes anyway — not only because of the AI Act, but because platforms and advertisers increasingly want machine-checkable signals.
The best move is to build a two-layer approach:
- a user-visible disclosure (“AI-generated”) for UX and policy
- a machine-readable signal for downstream platforms and detection tooling
Platforms and app stores (the “nudifier” ban)
Nudifier apps became a case study in how fast harmful capability can be packaged, distributed, and monetized.
A targeted ban here is a warning shot to marketplaces: if you profit from distribution, lawmakers will treat you as part of the system unless your guardrails are real.
What changes next (builder checklist)
Treat this as a timeline shift — and a signal about enforcement priorities — not a reason to postpone engineering.
- Map your features to “likely high-risk” categories now. Even if timelines move, classification work is a forcing function for better design.
- Add model + dataset versioning to your audit trail. If you cannot answer “what model produced this output on this date,” you will fail procurement even before regulation bites.
- Design watermarking/provenance as infrastructure. Make it a pipeline, not a post-processing script.
- Build explicit consent + abuse prevention for any image feature. If your product can be used for non-consensual sexual content, regulators will assume it will be.

The EU is not backing away from regulating AI. It is changing the clock and picking a visible harmful use case to clamp down on.
For builders, the strategy is straightforward: use the extra runway to make compliance cheap (instrumentation, provenance, documentation) — and make abuse expensive (consent, safety measures, and distribution controls).
